They had just bought the home a year earlier and had put very little down on it. They hadn't had time to build equity before her husband's job transfer came in, and my commission, along with the closing costs, ate what little there was. It was just that she found all this out this morning. The title company didn't have the closing statement ready until the last moment.&lt;br /&gt;&lt;br /&gt;In any case, she was happier than she had been lately, because the home was finally sold and she would soon be joining her husband. The buyer, on the other hand, wasn't happy at all.&lt;br /&gt;&lt;br /&gt;"What's this charge here?" he asked the title company representative who was doing the closing. She explained that it was for the propane in the tank. The seller had paid $300 to have the tank filled, and it was still half full. It was standard procedure to have the buyer pay for any propane still in the tank.&lt;br /&gt;&lt;br /&gt;"I'm not paying that $150!" he insisted. The agent who had sold him the home patiently explained that he would have to buy propane to heat the home in any case, so it was only fair that he pay. He couldn't expect the seller to give him $150 worth of free propane. Unfortunately, that's exactly what he expected.&lt;br /&gt;&lt;br /&gt;"I'll walk out of here before I pay for that!" he announced, turning red. The seller began to cry. The closing agent tried again to convince the man that this was fair. He again refused.&lt;br /&gt;&lt;br /&gt;"I don't care!" the seller almost yelled. "I'll give him the propane." The closing agent left the room to change all the documents to reflect the new agreement. The seller was losing another $150 on her home. She wiped her tears and said, "I hope there's nothing else." Fortunately, there wasn't.&lt;br /&gt;&lt;br /&gt; &lt;b&gt;Preparing For A Real Estate Closing&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;I never did like being a real estate agent. But as you can imagine, after that I was at least more prepared for real estate closings. Here are some of the ways that you can be too.&lt;br /&gt;&lt;br /&gt;1. Ask your real estate agent what will happen at the closing, and make a list. Call the closing company to verify that this is correct, and that it is everything.&lt;br /&gt;&lt;br /&gt;2. Have everything you need (papers, cashiers check, keys, etc) ready the day before closing, and check with your real estate or closing company agent to verify that you have what you need.&lt;br /&gt;&lt;br /&gt;4. When agreeing to use a closing company, make it clear that you will only use one that has closing statements ready at least two days before closing. They are supposed to help you decide if buying a house makes financial sense for you, but do they really tell you what you need to know? Let's take a look at how they work, and how they sometimes don't.&lt;br /&gt;&lt;br /&gt; &lt;b&gt;To Rent Versus Buy&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;The idea of these calculators is to take into account all the costs of both renting and buying over a given time, to compare them and see which option is better. There are a number of criteria involved, though, and this means there will always be some guessing. How many years will you be in the home? How much will rent be up to in ten years? How high will your property taxes be? These fields will be filled in by default in most calculators, and you'll change them as needed.&lt;br /&gt;&lt;br /&gt;I just went to the U.S. Government's site, ginniemae.gov to see their rent-versus-buy calculator. Their fields start (mid 2007) with an assumption of ten years in a house, a 7.5% interest rate, and 2% annual appreciation - all very conservative guesses. Here is what all of the criteria were preset at:&lt;br /&gt;&lt;br /&gt; Your Current Monthly Rent: $750&lt;br /&gt; The Price of Home: $150,000&lt;br /&gt; The Down Payment: $15,000 (10%)&lt;br /&gt; Term Of &lt;a id="KonaLink0" target="_new" class="kLink" style="text-decoration: underline ! important; position: static;" href="http://www.articlesbase.com/real-estate-articles/beware-the-rent-versus-buy-calculator-208003.html#"&gt;&lt;span style="color: rgb(0, 153, 0) ! important; font-family: Verdana,Arial,sans-serif; font-weight: 400; font-size: 13.3333px; position: static;color:#009900;" &gt;&lt;span class="kLink" style="color: rgb(0, 153, 0) ! important; font-family: Verdana,Arial,sans-serif; font-weight: 400; font-size: 13.3333px; position: static;"&gt;Loan&lt;/span&gt;&lt;/span&gt;&lt;/a&gt; (years): 30&lt;br /&gt; Interest Rate On Loan: 7.5%&lt;br /&gt; Estimated Years In The Home: 10&lt;br /&gt; Annual Property Tax Rate: 1%&lt;br /&gt; Annual Home Value Increase: 2%&lt;br /&gt;&lt;br /&gt;You can change any of these. For example, property taxes are closer to 2% of property value in some areas. Over 10 years appreciation will probably be more than 2% annually (although it could well be a negative number this year and next). Hitting the "calculate" button, this is what was shown:&lt;br /&gt;&lt;br /&gt; Home Value In Ten Years: $182,849&lt;br /&gt; Loan Balance After 10 Years: $117,340&lt;br /&gt; Your Equity: $65,509&lt;br /&gt; Tax Savings (at 28%): $32,549&lt;br /&gt; The Average Monthly Payment Over Time: Rent: $834 - Buy: $550&lt;br /&gt; Total Payments Over Ten Years: Rent: $100,080 - Buy: $66,017&lt;br /&gt; Your Total Savings On: Buying - $34,063&lt;br /&gt;&lt;br /&gt;Confusing. My amortization table shows that the payment on a 30-year, 7.5% loan would be $944 per month, not $550 - and this doesn't include mortgage insurance, property taxes or home owner's insurance. They may take into account the tax savings, but that still doesn't explain how they arrive at $550. There is this little note at the bottom:&lt;br /&gt;&lt;br /&gt; "The above rent-versus-buy calculator uses the following in its calculations: &lt;a id="KonaLink1" target="_new" class="kLink" style="text-decoration: underline ! important; position: static;" href="http://www.articlesbase.com/real-estate-articles/beware-the-rent-versus-buy-calculator-208003.html#"&gt;&lt;span style="color: rgb(0, 153, 0) ! important; font-family: Verdana,Arial,sans-serif; font-weight: 400; font-size: 13.3333px; position: static;color:#009900;" &gt;&lt;span class="kLink" style="color: rgb(0, 153, 0) ! important; font-family: Verdana,Arial,sans-serif; font-weight: 400; font-size: 13.3333px; position: static;"&gt;homeowner's &lt;/span&gt;&lt;span class="kLink" style="color: rgb(0, 153, 0) ! important; font-family: Verdana,Arial,sans-serif; font-weight: 400; font-size: 13.3333px; position: static;"&gt;insurance&lt;/span&gt;&lt;/span&gt;&lt;/a&gt;, loan costs, mortgage insurance, cost to sell the home, property tax, homeowner's tax savings, and increases in rent. Results are estimates. "&lt;br /&gt;&lt;br /&gt;Well, that certainly doesn't clear things up, but it does point out some other issues, like the fact that there is no calculation at all for repair costs. Having owned several homes, I can tell you that there will be repairs and maintenance. We also don't know if rising property taxes were taken into account. Also if you are in the 15% tax bracket (likely if you're renting a $750 apartment), the tax savings would be about $15,000 less than calculated - a little bit of difference.&lt;br /&gt;&lt;br /&gt;Now, even at a more reasonable 6.5% interest rate, the monthly cost of owning a $150,000 home (with taxes, insurance, and minor repairs) is a minimum $1,150 - and probably higher than that. Using the above example, this is $400 more per month than renting. My guess is they take into account the "opportunity cost" of not having that $400 per month to &lt;a id="KonaLink2" target="_new" class="kLink" style="text-decoration: underline ! important; position: static;" href="http://www.articlesbase.com/real-estate-articles/beware-the-rent-versus-buy-calculator-208003.html#"&gt;&lt;span style="color: rgb(0, 153, 0) ! important; font-family: Verdana,Arial,sans-serif; font-weight: 400; font-size: 13.3333px; position: static;color:#009900;" &gt;&lt;span class="kLink" style="color: rgb(0, 153, 0) ! important; font-family: Verdana,Arial,sans-serif; font-weight: 400; font-size: 13.3333px; position: static;"&gt;invest&lt;/span&gt;&lt;/span&gt;&lt;/a&gt; over 10 years. The primary difference is that the deed is not signed over to the buyer until after the last payment. With a mortgage, you give the buyer the deed and take back a mortgage, which then pledges the property as collateral for the money owed to you. But which is better?&lt;br /&gt;&lt;br /&gt;That depends. In theory you have the same security in both cases, since there are clear procedures in the legal system for foreclosing on and taking back the property if the buyer defaults. However, the two types of contracts are sometimes handled in different courts. This can be important. Suppose, for example, that the court system which handles land contracts takes six months to process a foreclosure, but the one that processes mortgage foreclosures is chronically backlogged and takes two years. Do you want a non-paying buyer to live in your home for years?&lt;br /&gt;&lt;br /&gt;The opposite to the above could be the case in your area, so ask a good real estate attorney before deciding which way to offer seller financing. Of course, if it takes years in both cases, reconsider the whole plan, especially if you will be relying on the income or taking a small down payment.&lt;br /&gt;&lt;br /&gt; &lt;b&gt;The Disadvantages Of Land Contracts&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;It may feel safer to keep the deed in your name, but that part isn't a real issue. As noted, there are procedures to get the property back in either case, so it's really only important which takes longer. But what if they are taking about the same amount of time? Having sold several properties on land contracts, I now think there may be some disadvantages when compared to taking back a mortgage.&lt;br /&gt;&lt;br /&gt;My first lesson about this came a few years back when I was facing a $500 (or larger) fine for some junk cars in the yard of a small rental home. "But I sold the property years ago!" I protested to the township official. That's when I learned that they would hold me responsible for ANYTHING wrong with the property until I transferred the deed to the new owner. I had sold to him on a land contract, and he still had several more years to pay.&lt;br /&gt;&lt;br /&gt;I would have marched down there and told the renter living there to get rid of the cars, but I had no right. The new owner was the landlord after all. I called him, called again to remind him, and he called the tenant, who moved the cars just before the fifteen-day deadline.&lt;br /&gt;&lt;br /&gt;My most recent lesson came in the mail from the county where we sold our home two years ago. We sold it on a land contract, happy that we got 10% more by doing it this way. Now, however, the buyer hadn't paid the property taxes for a year. Again, a couple phone calls got this resolved, and this could happen if we had sold and taken back a mortgage too, but that wasn't the end of this matter. To do this, start getting his verbal commitment to anything and everything along the way to a discussion of price. There are two reasons that this can work.&lt;br /&gt;&lt;br /&gt;First, the process of saying yes many times just makes a seller more likely to say yes to whatever else you ask - including a lower price. You essentially are conditioning him. You are getting him in the habit of saying yes. He may not say yes to everything, but he will be more likely to move in your direction.&lt;br /&gt;&lt;br /&gt;The second reason this works involves another technique for negotiating real estate deals. That is the technique of asking for many things in order to have something to "throw back into the pot" when it comes time to talk about the things you really want. Yes, there are pockets out there that are still doing relatively well (not what it once was, but still producing sales).&lt;br /&gt;&lt;br /&gt;People are asking what is wrong? I would say that there are many factors that I see that is affecting the housing sales.&lt;br /&gt;&lt;br /&gt;First, many are saying, "the rates have crept up too high," funny they are still at their historical lows. I recall Mr. &lt;span class="blsp-spelling-error"&gt;&lt;span id="SPELLING_ERROR_0"&gt;Cavuto&lt;/span&gt;&lt;/span&gt; on Fox News saying when he was in his younger years, he bought a home with the interest rate of 13% and he was grateful to even get that. I myself bought my first home in 1996 and my mortgage rate was 6.5%. I thought I was the King of World. Right now, a VA loan is going for 6.625% to 6.75%. What is wrong with people? There is absolutely no excuse with the rates.&lt;br /&gt;&lt;br /&gt;Then you are facing the inflated home prices that have went up dramatically over the years, while at the same time average family incomes have not increased at the same speed. Yes, we must keep in mind, &lt;st1:state st="on"&gt;&lt;st1:place st="on"&gt;Kentucky&lt;/st1:place&gt;&lt;/st1:State&gt; has not inflated in prices as dramatic as in many other areas of the country. So essentially, when people see what they can get with their money it just doesn't add up. We are seeing homes in the low $100k down to $80k (please remember, this is smaller &lt;st1:state st="on"&gt;&lt;st1:place st="on"&gt;Kentucky&lt;/st1:place&gt;&lt;/st1:State&gt; communities) have many issues with these homes or they are to small and can't necessarily fit a family of 4 in it.&lt;br /&gt;&lt;br /&gt;So, what must happen in this case you might ask? Either America is going to have to be willing to do one of the 5: go smaller and accept it; cough up the extra money in a monthly payment (if the money is there); wait for the market to correct itself (home prices to fall slightly, in our marketplace); average family income rises; or the family's income rises by default (because there is an income change within the home for the better).&lt;br /&gt;&lt;br /&gt;In my next posting, I plan on discussing what did the &lt;span class="blsp-spelling-error"&gt;&lt;span id="SPELLING_ERROR_1"&gt;subprime&lt;/span&gt;&lt;/span&gt; mortgage market do to the real estate market? According to the U.S. Government Accountability Office, the federal government will face a fiscal crisis as the cost of entitlement programs for Older Adults is expected to exceed revenues with the retirement of the baby boomers. &lt;/p&gt;&lt;p&gt;From the consumer perspective, AARP data consistently shows 9-in-10 older adults want to, or by necessity, will "age in place" or stay in a home with living services and other like-minded individuals for the remainder of their lives. Furthermore, AARP surveys of younger adults (age 45 and older) also indicate the vast majority of adults (better than 80 percent) want to age in place and expect to receive the services needed to do so. &lt;/p&gt;&lt;p&gt;From this vantage point, it only makes sense that builders place greater attention and resources on increasing opportunities for and improved quality of community-based services, in step with consumer trends and demographic shifts.
